Consumer Rights Directive

On June 13th 2014, the new Consumer Rights Directive came into force. Consumers now benefit from increased protection when shopping online from web traders based in Ireland and other EU countries, as the directive replaces previous legislation on distance contracts with more up-to-date rules. Among the provisions that have been introduced are bans on hidden charges, as well as an extended right of withdrawal period. Consumers will also be entitled to be refunded more promptly.

Extended “cooling off” period

Before the new directive came into effect, consumers could withdraw from a distance selling contract and seek a full refund within seven days of the date on which they received the goods. The only cost to the consumer in this situation is the direct cost of returning the goods to the seller. The new directive has extended this cooling off period to 14 days from the day the consumer receives the item. Traders may also opt to provide a sample withdrawal form on their website, making it easier for consumers to avail of this right.

Ban on pre-ticked boxes

It is a common practice for retailers who offer additional services (such as insurance) to pre-tick boxes during the booking process. However, this may cause some consumers to inadvertently pay for extras that they do not require. Under the new directive, this practice is no longer permitted and consumers must explicitly indicate that they consent to any extra payment.

Ban on hidden fees and charges

Retailers must disclose the total cost of the product or service, including any additional fees (e.g. taxes, delivery charges), before the order is placed.


Online shoppers do not have to pay extra charges if they were not properly informed of these costs in advance.

Right to quicker refunds

Previously, online sellers were obliged to refund consumers who withdrew from a contract within 30 days. Under the new directive, this period has been shortened to 14 days, and the refund must include the cost of delivery.

Ban on surcharges

The new legislation prohibits retailers from imposing credit or debit card charges which exceed the actual cost of offering this means of payment.

Clearer information on the cost of returning unwanted goods

Consumers who avail of the cooling off period must bear the cost of returning unwanted goods. The new directive stipulates that if a seller expects the consumer to pay to return an item, they must clearly inform the consumer of this beforehand.

The Cost of returning an unwanted item via DPD Couriers is currently: €8.50

Otherwise, they will have to cover the cost of returning the item themselves. Sellers are also obliged to provide an estimate of return costs in advance if the item is bulky or difficult to transport, so that consumer may make an informed decision before purchasing the goods.
